Used Truck Still Under Loan? How Hypothecation Removal (Form 35) Works Before You Buy

Many used trucks are sold while a bank or NBFC loan is still running, or after the loan is repaid but with the lender's name still printed on the RC. Both situations can stall your ownership transfer. This guide explains what hypothecation is, how it gets removed, and the safe order of steps for a buyer.

What Hypothecation on an RC Means

When a truck is bought on finance, the lender's name is entered on the Registration Certificate. That entry tells everyone the lender has a claim on the vehicle until the loan is cleared. Repaying the loan does not automatically remove it. The bank's name stays on the RC until the owner formally applies to remove it.

Why It Matters to You as a Buyer

Hypothecation blocks the sale and transfer of a vehicle without the bank's consent, and it also blocks re-registration in another state and the inter-state NOC. If a truck is sold with hypothecation still on the RC, the buyer can face transfer and insurance complications, and the RTO may not process the transfer cleanly. Until the entry is removed, the truck is not fully the seller's to sell. Same-state transfer steps are in our ownership transfer guide (/blog/transfer-ownership-used-commercial-vehicle-india-forms-noc-timeline).

How Removal Works: Form 35, Step by Step

Form 35 is the application to terminate hypothecation under Rule 61(1) of the Central Motor Vehicles Rules, 1989.

  1. The seller closes the loan fully and collects a No Dues Certificate or NOC from the bank or NBFC. Lenders typically take about a week to two weeks for this. Some digital lenders are faster.
  2. The bank co-signs Form 35 along with the owner. The financer's signature is mandatory, and a missing bank signature is a common reason for rejection.
  3. The papers are submitted at the RTO where the truck is registered. In some states, including Maharashtra, this can be done online through mParivahan. Other states may need at least one RTO visit.
  4. The RTO removes the entry and issues an updated RC.

Documents Usually Needed

Original RC, bank NOC or loan closure letter showing the right loan, vehicle, and chassis numbers, Form 35 signed by owner and bank, valid insurance and PUC, and the owner's ID and address proof. If the truck is being sold at the same time, Form 29 may be filed alongside. Commercial vehicles may also need permit documents. See the driver documents checklist (/blog/documents-commercial-vehicle-driver-must-carry-india).

Cost and Timeline

Government fees are modest, typically a few hundred rupees, and they vary by state. Most RTOs take roughly 7 to 30 working days. Busy offices can take longer. A bank NOC is typically valid for about 90 days, so file promptly.

Buying a Truck Whose Loan Is Still Running: The Safe Order

  • Ask for the RC and check which lender is shown.
  • Ask the seller for a written loan-closure statement from the lender.
  • Make sure the loan is closed through the lender, with the closure and NOC documented, before the final payment, not after.
  • Do not accept "I will give you the NOC later." Without the NOC and Form 35, you cannot complete your own transfer cleanly.
  • Complete the ownership transfer within the legal timeline.

Red Flags

  • Seller cannot name the lender.
  • RC copy only, no original.
  • "NOC is with the bank, will arrive."
  • Loan closure letter with the wrong chassis number.
  • Pressure to pay in full before any paperwork is shown.

How BiggWheels Handles It
