Selling a Used Truck in India: Stay Off the Hook for Challans After the Sale
Most guides are written for the buyer. The seller has a separate risk: until the RC is transferred, the seller stays the registered owner on record. Challans and notices can still land on that name.
Step 1: Price From a Real Valuation
Start with model, age, condition, and papers, not a round number. See the used truck valuation guide (/blog/how-much-is-my-used-truck-worth-valuation-guide).
Step 2: Clear the Loan and Hypothecation
If a loan is still open, close it and get the bank NOC and Form 35 done so the lender's name comes off the RC. A bank entry makes the truck harder to transfer. See the hypothecation guide (/blog/used-truck-hypothecation-removal-form-35).
Step 3: Clear Challans and Dues
Check pending challans on Parivahan and clear them before you hand the truck over. Dues can block an interstate NOC and put buyers off. See the challan guide (/blog/check-pending-challans-used-truck-before-buying).
Step 4: Keep the Papers Ready
Original RC, valid insurance, PUC, fitness certificate and permit where they apply, service records, bank NOC if there was a loan, and your ID and address proof.
Step 5: Sign a Dated Sale Agreement
Include the buyer's full name, address, an ID copy, and the agreed price. That agreement is your proof of the sale date and of who took the truck.
Step 6: Hand Over the Papers and Sign the Transfer Forms
Form 30 is the buyer's application for transfer. Form 29 is the seller's notice of transfer. Keep copies. The full same-state process, fees, and timeline are in the ownership transfer guide (/blog/transfer-ownership-used-commercial-vehicle-india-forms-noc-timeline).
File Form 29 Yourself
A seller can file Form 29 at their own RTO even if the buyer has not yet filed Form 30. That filing does not complete the transfer. It creates a dated record that the vehicle was sold and handed over. Keep the RTO acknowledgement.
The Transfer Window
For a commercial vehicle, complete the ownership transfer within 30 days of sale. Private vehicles sit on a 14-day clock. Late transfers can attract a state late fee, and the previous owner stays exposed until the RC moves.
Why You Stay Liable Until the RC Moves
Until the RC is formally transferred, the seller remains the registered owner on VAHAN. Notices for challans, fines, or an accident involving the truck go to that name, even if someone else is driving. One reported example described a seller who skipped Form 29 and later received challans of about ₹14,000 plus a summons after a minor accident. Treat that as one reported case, not a typical bill.
Follow Up on VAHAN
A few weeks after the sale, check the VAHAN record and confirm the buyer's name is on the RC. If it is not, your Form 29 acknowledgement and the sale agreement are the evidence to show.
Insurance After the Sale
Ask how the policy will be transferred or cancelled so cover does not stay in your name by default. See the insurance transfer guide (/blog/commercial-vehicle-insurance-transfer-used-vehicle-buyers).
