GST on Used Commercial Vehicles in India: What Buyers and Sellers Need to Know
GST on a used commercial vehicle only applies when the seller is a GST-registered dealer, a private, individual-to-individual sale attracts no GST at all. When it does apply, it's charged under the Margin Scheme at 18%, and only on the margin (the dealer's profit, selling price minus purchase price), never on the full sale price. If a dealer sells at a loss, no GST applies on that transaction at all.
The Short Answer, It Depends Who's Selling
- Individual selling their own vehicle to another individual: No GST, regardless of the sale price.
- GST-registered dealer selling a used vehicle: 18% GST applies, but only on the dealer's margin, not the full transaction value.
This distinction is the single most important thing to understand, because it directly affects what a fair, transparent price should look like depending on who you're buying from.
The Margin Scheme, Explained Simply
Under Rule 32(5) of the CGST Rules, 2017, registered dealers pay GST only on the difference between what they paid for a vehicle and what they sell it for, not on the vehicle's full value. This prevents the same vehicle's value from being taxed repeatedly as it changes hands, and it's the reason a dealer's used vehicle price isn't simply "market price plus 18%."
This rate, 18% on margin, has applied uniformly to used vehicles (including EVs) since 16 January 2025, under Notification No. 04/2025-Central Tax (Rate), which replaced a previous structure where rates varied more by vehicle type.
A Worked Example
A dealer buys a used truck for ₹8,00,000 and sells it for ₹9,50,000.
- Margin = ₹9,50,000 − ₹8,00,000 = ₹1,50,000
- GST payable = 18% of ₹1,50,000 = ₹27,000
This ₹27,000 is on the margin, not on the ₹9,50,000 sale price, which would have been ₹1,71,000 if charged on the full amount. Margin maths also depends on a clear assessed value, see our used truck valuation guide (/blog/how-much-is-my-used-truck-worth-valuation-guide).
What If the Sale Price Is Lower Than the Purchase Price?
If a dealer sells a vehicle for less than they paid for it (or its depreciated value, if depreciation was claimed under the Income Tax Act), the margin is negative, and no GST applies to that sale at all. This is a deliberate design of the scheme: it taxes profit, not the transaction itself.
The 1% TCS Rule for High-Value Vehicles
Separately from GST, under Section 206C(1F) of the Income Tax Act, sellers must collect 1% Tax Collected at Source (TCS) on the sale of a motor vehicle where the invoice value exceeds ₹10 lakh, calculated on the invoice value including GST. This is common for many used commercial vehicles given typical price ranges, so it's worth confirming with your dealer whether TCS applies to your specific transaction and how it's reflected on your invoice.
What This Means for You as a Buyer
- If buying from a registered dealer, ask for a clear breakdown showing the margin calculation and GST amount, a transparent dealer will show this without hesitation
- If buying privately from an individual, confirm there's genuinely no GST-registered business involved in the transaction, since the exemption only applies to true individual-to-individual sales
- If your purchase price is above ₹10 lakh, confirm whether 1% TCS applies and how it appears on your documentation
